Terms & Conditions
These terms govern the use of services and materials provided by Retiraq, an educational and records-organisation practice based in Georgetown, Penang, Malaysia.
1. Definitions
In these Terms and Conditions, the following words carry the meanings given to them here:
- "Retiraq", "we", "us" or "our" refers to Retiraq, a records-organisation and retirement-literacy practice registered and operating at 28A Lebuh Chulia, 10200 Georgetown, Penang, Malaysia.
- "Participant" or "you" means any individual who enrols in, registers for, or attends a session, course, or programme offered by Retiraq.
- "Services" means the educational and records-organisation sessions, courses, and programmes described on this website, delivered in-person or at the participant's home as specified.
- "Materials" means any handouts, folder templates, reading lists, printed references, or other items provided to participants in connection with a Service.
- "Agreement" means these Terms and Conditions, together with any booking confirmation or enrolment acknowledgement issued by Retiraq.
- "Website" means the pages and content available at retiraqad.world.
2. Acceptance of Terms
By booking, registering for, or attending any Service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
Our Services are intended for adults aged 18 years and over. By proceeding with an enrolment, you confirm that you meet this requirement and that you have full legal capacity to enter into this Agreement.
If you are booking on behalf of another person or a couple, you represent that you have authority to accept these Terms on their behalf, and that all parties are aware of and agree to these Terms.
3. Service Description
Retiraq offers three categories of Service, each of which is described in full on our website:
- A guided one-day records-organisation session for individuals or small groups;
- A six-session weekly retirement literacy course conducted as a reading group; and
- A year-long household records-refresh programme for couples, including in-home sessions and an annual review.
All Services are conducted in English and are designed for participants located in Peninsular Malaysia. Services are delivered in person at our Georgetown premises or, for certain programmes, at the participant's home address as agreed at the time of booking.
Service availability is subject to scheduling. We do not commit to specific dates until a booking is confirmed in writing.
4. Enrolment & Participation
Enrolment is confirmed when Retiraq issues a written booking acknowledgement and any applicable deposit or full payment has been received. Places are not reserved until payment is received.
Participants are expected to attend all scheduled sessions in their chosen Service. Where a participant misses a session in a multi-session Service, we will make reasonable efforts to provide summary notes, but we do not commit to rescheduling missed sessions as a matter of course.
For the one-day session and the couples' programme, you are responsible for having your own documents available and organised in preparation for the session, as described in our pre-session information.
Retiraq reserves the right to decline or discontinue participation by any person who behaves in a manner that disrupts the session or is disrespectful to staff or other participants.
5. User Responsibilities
When using our Services or Website, you agree to:
- Provide accurate information at the time of registration and notify us promptly if any details change;
- Treat our staff, facilitators, and other participants with courtesy;
- Handle any Materials provided to you with reasonable care and not reproduce or distribute them for commercial purposes;
- Keep personal documents and sensitive records that you bring to sessions secure, and not leave them unattended;
- Not use our Services or Website in any way that is unlawful, harmful, or likely to bring Retiraq into disrepute.
You acknowledge that the information and Materials provided in our Services are drawn from publicly available sources and are intended for general education and organisational purposes only. You take full responsibility for any decisions you make in relation to your own personal records, documents, or financial affairs.
6. Intellectual Property
All content on this Website — including text, layout, design, and graphic elements — and all Materials produced or used by Retiraq in connection with our Services remain the intellectual property of Retiraq or our licensed suppliers, unless otherwise indicated.
Participants are granted a personal, non-commercial, non-transferable licence to use any Materials provided to them as part of a Service, solely for their own household records-organisation purposes.
You may not copy, reproduce, republish, sell, or distribute any Materials in whole or in part without our prior written consent. This restriction does not apply to publicly available official publications referenced in our reading lists, which remain subject to their own terms of use.
7. Payment Terms
All fees are quoted and payable in Malaysian Ringgit (RM). Current pricing is as follows:

Payment is due in full at the time of booking confirmation unless a specific instalment arrangement has been agreed in writing. We accept bank transfer and cash payment at our Georgetown premises. Payment details are provided in the booking confirmation.
Pricing is subject to change. Any change to fees will not apply to bookings already confirmed in writing.
8. Cancellation & Refunds
Cancellation by participant: If you cancel more than 14 calendar days before the first session, you will receive a full refund less any applicable bank transfer fees. Cancellations made between 7 and 14 days before the first session are eligible for a 50% refund. Cancellations with fewer than 7 days' notice are not eligible for a refund, though we will consider rescheduling requests on a case-by-case basis.
Cancellation by Retiraq: If we cancel a session for reasons within our control, we will reschedule at a mutually convenient time or provide a full refund at your election. In the event of cancellation due to circumstances outside our control (including illness of key staff, natural events, or government directives), we will make reasonable efforts to reschedule and will not charge for sessions that could not be delivered.
For the yearly couples' programme, individual follow-up sessions that are not attended cannot be individually refunded, though we will make reasonable efforts to reschedule where reasonable notice is given.
9. Disclaimers
Retiraq provides educational and organisational services only. Nothing in our sessions, Materials, or Website constitutes financial, legal, investment, or tax advice of any kind. You should consult a qualified and licensed professional for any decision concerning your personal financial or legal circumstances.
Information shared in our courses and sessions is drawn from publicly available materials and official publications. We do not represent that this information is complete, current, or suitable for any individual's particular situation.
Our Services are provided in good faith, but we do not make any representation that participation will result in any particular outcome in relation to your retirement planning, document organisation, or financial preparedness.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Retiraq's total liability to any participant in connection with a Service shall not exceed the amount paid by that participant for the relevant Service.
We will not be liable for any indirect, incidental, special, or consequential loss, including any loss arising from reliance on Materials or information provided in a session, loss or damage to documents brought to a session, or any outcome arising from decisions made on the basis of information shared in our Services.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
11. Indemnification
You agree to indemnify and hold harmless Retiraq and its staff from any claim, loss, damage, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of our Services or Materials, or any act or omission by you that causes harm to Retiraq, our staff, or other participants.
12. Termination
Either party may end a booking by giving written notice. Where you terminate, cancellation and refund terms in Section 8 apply.
We may terminate your participation in a Service without refund where you have materially breached these Terms and, if the breach is capable of remedy, have not remedied it within 5 business days of notice from us.
Sections 5, 6, 9, 10, and 11 of these Terms survive termination of any Agreement.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Both parties submit to the non-exclusive jurisdiction of the courts of Penang, Malaysia.
Before commencing any formal proceedings, the parties agree to attempt to resolve any dispute in good faith through direct communication. Unresolved disputes may be referred to mediation through an accredited mediation centre in Malaysia before litigation is commenced, unless the matter is urgent.
Your statutory rights as a consumer under Malaysian law, including those under the Consumer Protection Act 1999, are not affected by these Terms.
14. General Provisions
- Entire Agreement. These Terms, together with any booking confirmation, constitute the full agreement between the parties regarding the relevant Service and supersede all prior discussions or representations.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- No Waiver. Failure by either party to enforce any term does not constitute a waiver of the right to enforce it in future.
- Assignment. You may not assign your booking or rights under these Terms without our prior written consent. We may assign our rights to a successor organisation that continues to operate equivalent Services.
- Notices. Formal notices under these Terms should be sent to [email protected] or by post to our Georgetown address.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, applicable law, or operational requirements. The updated version will be published on our Website with a revised effective date.
For participants with an active booking at the time of any material change, the Terms in effect at the time of booking will continue to apply to that booking, unless both parties agree in writing to the updated Terms. For new bookings made after publication of revised Terms, the revised Terms apply.
